These Terms are a contract between you and Vipernaut ("we", "us"), the operator of Vipernaut (the "Game"), covering the website at viperaunt.com, the Discord activity, and any mobile or beta builds we publish. By playing, you agree to them. If you do not agree, do not play.

1. Who may play

You must be at least 13 years old (16 in the United Kingdom and the European Economic Area, or the minimum age of digital consent where you live).
If you are under 18, you may only play with the permission of a parent or guardian, and only they may make purchases.
We do not knowingly collect personal information from children under 13. If you believe a child under 13 has an account, contact us and we will delete it.

2. Your account

The Game does not require an email address. Your identity is a device key stored in your browser, or your Discord account if you sign in through Discord.
Keep your device key safe. It is the only way back into your account, and we cannot recover or reset it for you. Clearing your browser data may permanently lose access to that account, including any Venom or items on it.
You are responsible for everything done through your account.
One person may not run multiple accounts to gain an advantage, evade a ban, or manipulate leaderboards.

3. Rules of play

You agree not to:

cheat, automate, script, or use bots, modified clients, or tools that give an unfair advantage;
attack, overload, probe, or reverse engineer the Game or its servers, or interfere with anyone else's play;
choose names, avatars, group names, or send chat messages that are unlawful, hateful, harassing, sexual, threatening, or that impersonate another person;
buy, sell, or trade accounts, Venom, or items for real money outside the Game;
exploit bugs rather than reporting them.

We may remove content, reset scores, suspend, or permanently ban any account for breaking these rules, and we may do so without notice.

4. Content you submit

You keep ownership of the names, messages, and images you submit. You grant us a worldwide, non-exclusive, royalty-free licence to store, display, and transmit that content for the purpose of operating the Game. You confirm you have the right to submit it. We may moderate, refuse, or remove content at any time, and chat and profile content may be reviewed by moderators.

5. Venom and virtual items

Venom, revive tokens, cloak time, and every other in-game item have no real-world value and are not your property. They are a limited, personal, non-transferable, revocable licence to use a feature inside the Game.

Venom and items cannot be exchanged for money or transferred outside the Game.
We may change prices, balance, earn rates, or what any item does, at any time, including reducing or removing items already held.
Unused Venom and items are forfeited if your account is closed, banned, or deleted, and expire when the Game ends.
Nothing in this section limits any right you have under the consumer law of your own country.

6. Purchases and refunds

Payments are processed by Stripe. We never see or store your card details.
Prices are in US dollars and exclude any tax that may apply where you live.
Purchases deliver digital content immediately. All sales are final and non-refundable, except where a refund is required by law, or where we choose to give one at our discretion.
If a purchase is not delivered, contact us and we will credit it or refund it.
Charging back a completed purchase instead of contacting us may result in your account being banned.

7. The Game may change or stop

The Game is provided as an ongoing service and is under active development. We may add, change, or remove features, reset or wipe progress and leaderboards, take servers down for maintenance, or discontinue the Game entirely. We will try to give notice of a permanent shutdown where reasonably practical, but we do not guarantee any level of availability, and we are not liable for lost progress, scores, Venom, or items.

8. Not affiliated with anyone else

Vipernaut is an independent game. The multiplayer snake genre is a common one, and a number of similar games exist. Vipernaut is not affiliated with, endorsed by, sponsored by, or connected to any other game or its developers, and any resemblance in genre, rules, or play is inherent to the format rather than an association between us.

We are likewise not affiliated with or endorsed by Discord, Stripe, Apple, or Google. Their names and marks belong to them. Where you reach the Game through one of those platforms, that platform's own terms also apply to you, alongside these.

9. Our rights

The Game, its code, artwork, name, and design are owned by us and protected by copyright and other laws. These Terms grant you a personal, revocable, non-transferable licence to play the Game for your own non-commercial entertainment, and nothing more.

10. Disclaimer

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, PROGRESS, OR VIRTUAL ITEMS. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE GAME IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) US$25.

Some places do not allow these exclusions, so parts of this section may not apply to you. Nothing here excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and costs arising out of your use of the Game, your content, or your breach of these Terms.

13. Suspension and termination

You may stop playing at any time and may ask us to delete your account. We may suspend or terminate your access at any time for breach of these Terms, for conduct that harms other players, or where required by law. Sections 5, 8, 9, 10, 11, 12, and 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in the State of Alabama, except that either party may seek relief in small claims court. Nothing in this section deprives a consumer of the protection of the mandatory law of their own country of residence.

15. Changes to these Terms

We may update these Terms. When we do, we will change the date at the top of this page, and material changes will be announced in the Game. Continuing to play after a change means you accept the updated Terms.
